Licensing Act 2003
Here you will find information on the various types of application that the licensing authority process under the Licensing Act 2003.
The Licensing Act 2003 licences:
Sale or supply of Alcohol:
- sale by retail
- supply by or on behalf of a club to a member of the club
Regulated Entertainment:
- A performance of a play
- An exhibition of a film
- An indoor sporting event
- A boxing or wrestling entertainment (indoor and outdoor)
- Performance of live music
- Any playing of recorded music
- A performance of dance
- Entertainment of a similar description to that falling within the performance of live music, the playing of recorded music and the performance of dance
Late Night Refreshment:
- provision of late night refreshment (hot food/drink)
Late night refreshment is only licensable between 11.00 pm and 5.00 am the following morning.
The Licensing Authority will determine and issue:
- Personal Licence (in relation to the sales of alcohol)
- Premises Licence - with alcohol
- Premises Licence - without alcohol
- Club Premises Certificate
- Temporary Event Notice
In exercising certain functions under the Licensing Act 2003, licensing authorities must have regard to the licensing objectives:
- the prevention of crime & disorder
- public safety
- the prevention of public nuisance
- the protection of children from harm
Experience shows that applications submitted without prior consultation with the Responsible Authorities or the local community can attract a high number of representations resulting in a Licensing Panel Hearing.
Applicants are advised to consult people affected by the proposals before submitting an application, for example by speaking to the Responsible Authorities, nearby residents and or community groups to discuss your proposals.
